bp charge offer Terms and Conditions (the offer) 

Background 

This document sets out the terms and conditions of the bp charge offer in partnership with bp charge.  

As part of this offer, you’ll receive a free Subscription Plan that provides access to exclusive discounts off bp charge’s standard EV charging rates (“Offer”). 

Agreement 

When you register for the Offer, you will be asked to accept the Offer terms below, along with bp charge terms and conditions and the bp privacy statement. It is important you read these before accepting. Contact’s general terms and conditions for residential and business customers and privacy policy, which you have already accepted, continue to apply.  

By accepting these bp charge Offer Terms and Conditions, you acknowledge and agree to legally binding agreements between you and Contact and you and bp.  

If there are any inconsistencies between the above listed terms and conditions, these bp charge Offer Terms and Conditions shall prevail. 

Definitions 

Benefits means:  

1. A base discount off bp charge’s standard retail price;
2. Any EV charging bonus offer which is available at certain times of day (‘Boost Discount’);
3. A waiver of the bp charge monthly subscription fee.

bp means BP Oil New Zealand Limited; 

bp privacy statement means the bp privacy statement which can be found here. 

Subscription Plan means the applicable Benefits available to you as an eligible Contact and bp charge customer.  

Subscription Terms means the applicable terms that can be found here. 

1. Eligibility & Benefits

1.1 To be eligible for the Offer, you must meet the following eligibility criteria:

1. Be a residential Contact Energy electricity customer with a post pay electricity account. Business, gas only or prepay customers are not eligible.
2. The email address registered to your Contact Energy account must match the email registered with bp charge.
3. You acknowledge and accept that by registering for the Offer you will become a bp charge customer. bp charge terms and conditions including Subscription Terms will apply in addition to the Contact Energy general terms and conditions for residential and business customers and these must be read and accepted by you along with these EV Charging Offer Terms and Conditions.
4. You must remain a Contact electricity customer with a post pay electricity account to receive the Offer. If you withdraw from the Offer or leave Contact, you will remain a bp charge customer but will not receive the Benefits.
5. The Benefits or Subscription Plan cannot be transferred to another person.

1.2 The Boost Discount applies when you start charging between the specified times. If you start charging before a specified Boost Discount time, the Boost Discount will not apply to the duration of your charge. If you start charging during a Boost Discount time and cease charging after a Boost Discount time, the Boost Discount will apply to the duration of your charge.  

2. Information Sharing

2.1 By agreement to these bp Charge Offer Terms and Conditions, you acknowledge and agree for Contact to share your personal information with bp for the purposes of facilitating the Offer. Personal information is limited to your first and last name, email address and your Driver ID.  

2.2 If you update relevant personal information with Contact, you agree Contact will share the updated personal information with bp for the purposes of facilitating the Offer. 

2.3 Personal information will only be used for the purposes of the Offer and in accordance with the Privacy Act 2020. 

2.4 bp charge will manage personal information held by bp in accordance with the bp privacy statement.  

2.5 You also agree that bp can share your personal information with Contact for the purposes of this Offer. 

3. Variations and Terminations 

3.1 The Benefits are listed on the Contact Energy website and may change from time to time. The Benefits available to you are confirmed after your account is set up and may vary from time to time in accordance with clause 8. 

3.2 The Benefits or Subscription Plan may be modified or terminated at any time. If this occurs, Contact Energy will notify you 10 business days prior to any change. 

3.3 Contact and/or bp charge may vary these bp charge Offer Terms and Conditions from time to time. If these changes are detrimental to you, we will notify you not less than 10 business days prior to the change. Contact Energy will not notify you about changes which do not affect you or are unlikely to have a material impact on you.  

3.4 You can withdraw from the Offer at any time by notifying us via [email protected] or calling us on 0800 222 730.

4. Liability

4.1 Subject to clause 12, Contact Energy is not liable to you for any loss or damage when using any EV charging station or charging site.   

4.2 Nothing in these bp charging Offer Terms and Conditions will limit or exclude Contact Energy’s liability to you for death or personal injury because of Contact Energy’s negligence, fraud or fraudulent misrepresentation, or any other matter in respect of which it would be unlawful for Contact Energy to exclude or limit liability.
